Terms and Conditions
When a client places an order for any work with Creations Rouge, that client confirms that they are in agreement with and bound by the terms and conditions below.
Any design work produced by Creations Rouge is done so at the exclusive direction of the client, based on information provided by the client. We reserve the right to refuse any commission with no reason given.
Textual content must be supplied by the client unless copyright services have been undertaken . All textual content supplied by the client must be in a text format and forward by email.
Textual translations must be provided by the client. A client can request a translation service to be provided by Creations Rouge. A separate fee will be charged, in advance, to the client, by Creations Rouge for any translation service undertaken.
A client may choose to withdraw from the contract at any stage but will be liable for cost of the work carried out up to the date of termination which includes the cost of any images that have been purchased on behalf of the client that were to be used in the website. Any termination of contract must be provided in writing.
Any content written and supplied by Creations Rouge must be approved by the client prior to the site going live. Creations Rouge will not be liable for any Copyright legalities, damages, costs, compensation or loss of earnings or business for images and text provided and incorporated in the web design by Creations Rouge.
We reserve the right to refuse any material or images of a copyrighted nature unless the client provides proof of permission to use the material or images that is provided by them.
Creations Rouge will abide by the licenses agreements enforced by Royalty Free Image providers for any images purchased on behalf of the client and incorporated in the web site.
Any permissions of rights and use of a company logos incorporated within the web design are the responsibility of the client. Creations Rouge are not liable for any breaches of contract or copyright, permissions, rights and use of a company logo supplied by the client and used in the design at the clients request.
Creations Rouge are not liable for any breaches of contract or copyright, permissions rights and use where changes have been made to the company logo at the request and and instruction of the client.
Any provisional designs, images, slogans created and supplied to the client are owned solely by Creations Rouge until final payment has been received and the website released to the client. Until such time they may not be replicated and reproduced by any other persons.
Creations Rouge will not be liable in any way for any damage of any type, be it direct, indirect, incidental, punitive or consequential, which could result from the use of access to or inability to use the information that is contained in any website or design work that Creations Rouge has designed.
We are not liable for any damages or viruses that may infect a site visitors computer equipment, software data or any other property which result from a site visitors access to any website that has been designed by Creations Rouge.
We will not be liable for any costs incurred, compensation or loss of earnings due to the unavailability of any of the sites designed by Creations Rouge.
Creations Rouge will not be liable for any costs incurred, compensation, lost of earning, loss of buisness when an original site or any site created by Creations Rouge has been removed at the request of the client
We will not be liable for hosting that we have purchased on your behalf. Creations Rouge recommends hosting companies to host clients websites and emails, but no guarantees can be made as to the availability of this hosting service. We cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect consequential or special loss.
We will not be liable for any damages that may result from downloading any material, data, photographs, images or audio from any site that we have designed.
The client will also agree to make available as soon as is reasonably possible all materials required to complete the design work requested and within any deadlines that have been agreed. We cannot be held liable for any costs that are incurred, compensation or loss of earnings due to failure to meet agreed deadlines.
We advise all our clients to make backups of their sites if they alter the data contained in it. We cannot be held responsible for a clients loss of data of their site. We will hold a back up copy of the initial site design.
All hosting account ftp details will be released once final payment has been made. Once they have been released they become the responsibility of the client.
It is the clients responsibility to ensure that the hosting account is renewed at the time it is requested by the hosting company. Creations Rouge are not liable for damage, costs or loss of earnings for any discontinuation of service provided by the hosting company.
We advice our clients to record and keep safe all hosting login information. Creations Rouge will not be liable for any Copyright legalities, damages, costs, compensation or loss of earnings or business for images and text provided and incorporated in the web design by Creations Rouge.
The client must provide a written approval of the site prior to it going live.
On commencement of works a deposit of 50 euros or 10% (whichever is the greater) is payable by the client with the balance being payable on completion of the work seven days from receipt of invoice. All invoices for work will be sent via email. Once the final payment has been received the site will be handed to the client. Creations Rouge reserves the right to withhold or remove any work created for a client from publication or submission prior to full and complete payment. All payments are due prior to the launch of a website. Non payment will result in legal action being taken if necessary.
Creations Rouge reserve the right to withdraw the work order at any time and terminate the contract. Creations Rouge must notify the client in writing when a contract is being terminated. If Creations Rouge terminates a work order and Creations Rouge will not be held liable for any loss of earnings, loss of business or costs incurred.
